Terms and Conditions

1. Introduction

Welcome to Elinkt.

These Terms & Conditions (“Terms”) govern your access to and use of the Elinkt platform and services, including Health Linkt and any other Elinkt services made available to you.

By accessing, activating, creating, using or otherwise interacting with an Elinkt service, you agree to be bound by these Terms.

If you do not agree with these Terms, you should not use the relevant Elinkt service.

These Terms should be read together with the Elinkt Privacy Policy, which explains how personal information is collected, used, stored and protected.

 

2. About Elinkt

Elinkt provides digital identification and information services designed to make selected information available when it may be needed.

Health Linkt uses a unique QR Code to provide access to an End User’s configured profile.

The service is intended to assist with:

  • Immediate identification
  • Access to selected medical information
  • Access to emergency contact information
  • Contact with designated Next of Kin
  • Access to selected healthcare information
  • Notification of designated contacts following a QR Code scan

The information available through a Health Linkt profile depends on the information provided by the End User and the functionality configured for that profile.

 

3. Definitions

For purposes of these Terms:

“Elinkt”

Means the Elinkt platform, website, applications, services and associated technology operated or provided by Elink PTY.

“Health Linkt”

Means the Elinkt service that provides QR Code-based immediate identification and access to selected profile information.

“End User”

Means the person whose Health Linkt profile is created and associated with a QR Code.

“QR Viewer”

Means a person who scans a Health Linkt QR Code and accesses the information made available through the QR profile.

“Next of Kin”

Means the person designated by an End User as their primary emergency contact.

“Alternative Contact”

Means a secondary emergency contact designated by the End User.

“Healthcare Provider”

Means a doctor, specialist, oncologist, dentist or other healthcare professional identified by an End User.

“Administrator”

Means an authorised person responsible for managing aspects of the Elinkt platform.

“QR Code”

Means the unique QR identifier associated with an Elinkt profile.

“QR Code REF”

Means the unique identifier assigned to a QR Code within the Elinkt system.

“Profile”

Means the information and configuration associated with an End User and their QR Code.

“Live Profile”

Means a production profile intended for actual customer use.

“Demo Profile”

Means a profile created for demonstration, testing, development, training or other non-production purposes.

 

4. Eligibility and Authority to Use the Service

You may only use Elinkt where you have the legal capacity and authority to do so.

By creating or managing a profile, you confirm that:

  • The information you provide is accurate to the best of your knowledge.
  • You are authorised to provide the information submitted.
  • You will not knowingly provide false or misleading information.
  • You will use the service only for its intended purpose.

 

5. Health Linkt Is an Information and Identification Service

Health Linkt is intended to assist with immediate identification and access to information supplied by the End User.

Health Linkt is not:

  • A medical service
  • An emergency response service
  • A substitute for emergency services
  • A medical diagnosis service
  • A medical treatment service
  • A replacement for professional medical advice
  • A replacement for official medical records

Information displayed through Health Linkt may be:

  • Incomplete
  • Incorrect
  • Outdated
  • Unavailable
  • Inaccurately entered by the End User
  • Unavailable due to technical or connectivity issues

You should not rely solely on Health Linkt where medical treatment, emergency assistance or professional medical assessment is required.

In an emergency, appropriate emergency services should be contacted.

 

6. End User Responsibilities

The End User is responsible for:

6.1 Providing Accurate Information

The End User must make reasonable efforts to ensure that information provided to Elinkt is accurate and not misleading.

This includes information relating to:

  • Medical conditions
  • Medication
  • Allergies
  • Blood type
  • Blood transfusion restrictions
  • Organ donor information
  • Next of Kin
  • Alternative contacts
  • Healthcare Providers
  • Medical aid information

6.2 Keeping Information Updated

The End User should update their profile when information changes.

This is particularly important for information that may be relevant during an emergency.

6.3 Protecting Account Access

The End User is responsible for maintaining the security of the email account associated with their profile.

The End User should notify Elinkt if they suspect unauthorised access or misuse.

 

7. Medical Information

Health Linkt allows End Users to voluntarily provide selected medical information.

The End User understands that:

  • Elinkt does not independently verify the medical information provided.
  • Elinkt does not determine whether information supplied by an End User is medically correct.
  • Medical information may change over time.
  • The End User is responsible for reviewing and updating their medical information.

The display of medical information through Health Linkt does not constitute medical advice or a medical assessment.

 

8. QR Codes

Each Health Linkt profile may be associated with a unique QR Code.

The QR Code provides a mechanism through which a QR Viewer may access the relevant Health Linkt profile.

The End User understands that:

  • The QR Code should be kept with or attached to the intended physical product.
  • The QR Code should not be intentionally shared or reproduced for unauthorised purposes.
  • The QR Code should not be altered in a way that prevents the service from functioning.
  • A QR Code should not be transferred to another person without appropriate authorisation.

A QR Code does not itself constitute proof of identity.

The information accessed through a QR Code is dependent on the information and settings associated with the relevant profile.

 

9. QR Viewer

A QR Viewer may scan a Health Linkt QR Code without having an Elinkt account.

The QR Viewer may be able to view information that the End User has made available through their profile.

The QR Viewer must use information accessed through Health Linkt responsibly and only for legitimate purposes.

A QR Viewer must not:

  • Attempt to gain unauthorised access to information
  • Circumvent security controls
  • Copy or misuse information for unlawful purposes
  • Attempt to modify an End User’s profile
  • Attempt to impersonate the End User
  • Use information for harassment, fraud, stalking or other unlawful activity

The QR Viewer does not have permission to modify the End User’s profile.

 

10. Scan Location

Where supported, a QR Viewer may be asked to permit access to the location of the device used to scan a QR Code.

If permission is granted, an approximate scan location may be processed and may be included in a notification to the End User’s designated Next of Kin.

If permission is denied, the QR scan may continue, but the location will not be provided through this functionality.

The scan location represents the approximate location of the device performing the scan, not necessarily the location of the End User.

Elinkt does not guarantee the accuracy of location information.

Location information may be affected by device settings, browser permissions, network conditions and other technical factors.

 

11. Next of Kin Notifications

Where enabled, a QR Code scan may result in a notification being sent to the End User’s designated Next of Kin.

The notification may include:

  • The End User’s name
  • QR Code reference
  • Information that the QR Code was scanned
  • Date and time of the scan
  • Whether location access was granted
  • Approximate scan location, where available

A QR Code scan does not necessarily mean that an emergency has occurred.

The notification is intended to help the designated contact become aware that the QR Code has been scanned.

Elinkt does not guarantee that a Next of Kin notification will be received immediately or successfully, as email delivery and other communication services may be affected by circumstances outside Elinkt’s control.

 

12. Email Verification and Profile Updates

Elinkt may require verification of the End User’s registered email address.

When creating or updating a profile, Elinkt may send a verification email.

Future profile changes may require an OTP or other verification mechanism.

The purpose of this process is to help ensure that profile changes are authorised by the person controlling the registered email address.

The End User is responsible for maintaining access to their registered email account.

 

13. Profile Availability

Elinkt aims to keep Health Linkt profiles available when required.

However, uninterrupted availability cannot be guaranteed.

The service may occasionally be unavailable because of:

  • Maintenance
  • Software updates
  • Hosting or infrastructure issues
  • Network failures
  • Internet connectivity
  • Security incidents
  • Third-party service failures
  • Events beyond Elinkt’s reasonable control

Elinkt will take reasonable steps to restore service following service interruptions.

 

14. Profile Status

A Health Linkt profile may have different statuses depending on its lifecycle.

These may include:

  • Active
  • Deactivated
  • Deleted

A deactivated profile may no longer be available through normal QR Viewer access.

Where permitted, a deactivated profile may subsequently be reactivated.

 

15. Live Profiles

A Live Profile is intended for actual customer use.

An Administrator may deactivate a Live Profile where permitted.

A Live Profile that has remained deactivated for the applicable period may become eligible for permanent deletion.

QR Code treatment

When a Live Profile is permanently deleted:

  • Associated profile information will be deleted in accordance with applicable retention requirements.
  • The associated QR Code REF will be permanently retired.
  • The QR Code REF will not be returned to the available QR Code pool.
  • The QR Code REF will not be allocated to another End User.

The purpose of permanently retiring a Live QR Code REF is to prevent an identifier previously associated with one End User from being reassigned to another person.

 

16. Demo Profiles

Demo Profiles may be created for demonstration, testing, development or other non-production purposes.

A Demo Profile may be deleted without the same waiting period applicable to a deactivated Live Profile.

When a Demo Profile is deleted:

  • Associated profile information will be deleted subject to applicable retention requirements.
  • The QR Code association will be removed.
  • The QR Code REF may be returned to the available QR Code pool.
  • The QR Code REF may subsequently be allocated to another profile.

 

Before reuse, the previous association must be fully removed so that the previous profile cannot be accessed through the QR Code.

 

17. Converting a Live Profile to Demo

Where the functionality is made available, an Administrator may change an Active Live Profile to a Demo Profile.

Once the profile has been converted to Demo, the applicable Demo lifecycle rules will apply.

This means that if the resulting Demo Profile is subsequently deleted, the associated QR Code REF may be released and returned to the available QR Code pool.

 

18. Legacy Profiles and Migration

Where existing Health Linkt customers are migrated from a previous Elinkt system to a new Elinkt deployment, reasonable measures will be taken to preserve continuity of service.

Where applicable, this may include preserving:

  • Existing profile information
  • Existing unique profile identifiers
  • Existing URLs
  • Existing QR Code associations

The purpose is to prevent an existing physical QR Code from becoming obsolete solely because the underlying platform has changed.

Migration may involve transferring or copying relevant information from the previous system into the new system.

The migration process will be subject to appropriate validation and security controls.

 

19. Deletion of Profiles

Profile deletion may be subject to different rules depending on whether the profile is Live or Demo.

When a profile is permanently deleted, Elinkt will handle the associated personal information in accordance with applicable law and its retention requirements.

Some information may need to be retained for a limited period where required for:

  • Legal obligations
  • Security
  • Fraud prevention
  • Dispute resolution
  • Audit purposes
  • Regulatory requirements
  • Backup systems

 

Where information is retained for such purposes, it should not continue to be used for ordinary service functionality unless otherwise permitted.

 

20. QR Code Retirement and Reuse

Elinkt distinguishes between retiring a QR Code and releasing a QR Code.

Retired QR Code

A retired QR Code REF:

  • Is permanently removed from future allocation.
  • Must not be assigned to another End User.
  • Must no longer provide access to the deleted profile.

Released QR Code

A released QR Code REF:

  • Has had its previous profile association removed.
  • No longer provides access to the previous profile.
  • May be returned to the available QR Code pool.
  • May subsequently be allocated to another profile.

A QR Code must never expose information belonging to a previous End User after its association has been removed.

 

21. Privacy

Your use of Elinkt is also subject to the Elinkt Privacy Policy.

The Privacy Policy explains:

  • What information Elinkt collects
  • Why information is processed
  • Who may access information
  • How information is protected
  • How long information may be retained
  • Your privacy rights
  • How to contact Elinkt about privacy matters

The Privacy Policy forms part of the overall documentation governing use of the Elinkt service.

 

22. Intellectual Property

Unless otherwise stated, the Elinkt platform, software, website, branding, logos, designs, graphics, content and underlying technology are owned by or licensed to Elinkt.

You may use the service only for its intended purpose.

You may not, without appropriate authorisation:

  • Copy the Elinkt software
  • Reverse engineer the platform
  • Reproduce proprietary functionality
  • Remove copyright or ownership notices
  • Use Elinkt branding in a misleading manner
  • Attempt to obtain source code or proprietary systems
  • Use Elinkt intellectual property to create a competing service

 

23. Acceptable Use

You must not use Elinkt to:

  • Commit or facilitate unlawful activity
  • Harass another person
  • Impersonate another person
  • Submit deliberately false information
  • Attempt unauthorised access
  • Circumvent security measures
  • Interfere with the operation of the service
  • Introduce malicious software
  • Scrape or systematically collect information without authorisation
  • Misuse information obtained through QR scanning
  • Use another person’s QR Code or profile without legitimate reason

 

Elinkt reserves the right to investigate suspected misuse and take appropriate action.

 

24. Suspension or Deactivation

Elinkt may suspend or deactivate access to a service where reasonably necessary to:

  • Protect the platform
  • Protect users
  • Investigate suspected misuse
  • Address security concerns
  • Comply with legal obligations
  • Prevent fraudulent activity
  • Maintain the integrity of the service

 

Where appropriate and legally permitted, Elinkt may provide notice before taking such action.

 

25. Third-Party Services

Elinkt may rely on third-party providers for services such as:

  • Hosting
  • Email delivery
  • Infrastructure
  • Security
  • Payment processing, where applicable
  • Analytics, where applicable
  • Other supporting services

 

Elinkt is not responsible for interruptions or failures caused solely by third-party services outside Elinkt’s reasonable control.

Third-party processing of personal information is addressed in the Privacy Policy.

 

26. No Guarantee of Emergency Response

Health Linkt does not guarantee that:

  • A QR Code will be scanned
  • A QR Viewer will act upon information displayed
  • A Next of Kin will respond
  • An email notification will be received
  • Emergency services will access the profile
  • A healthcare professional will use the information
  • The information will result in a particular outcome

The service is intended to assist with access to information. It does not replace human judgement, emergency services or professional medical care.

 

27. Acceptance of the Terms

During Health Linkt pre-onboarding, the End User will be provided with access to these Terms before proceeding.

The End User may be required to actively confirm acceptance.
